Currently at least 16 American states permit certain illegal immigrant/undocumented immigrant students to pay the same tuition as other in state students at publicly funded colleges and universities. The basic requirements of these laws generally include:
- Attendance at a school (primary or secondary) in the state for a minimum number of years;
- High School graduation from a school in the state;
- A signed affidavit declaring their intention to obtain legal citizenship as soon as they become eligible to do so.
